1.0 General

1.1 These terms and conditions (the "Terms and Conditions") are the terms and conditions upon which Lynda Owen ("we/us") makes this website ("www.lynda-owen.co.uk") available to you, the inclusion of any submission by users, the supply of goods purchased on-line and the use of any of our services which are accessible via this site.

1.2 This site is owned and operated by Lynda Owen ("we" or "us"). Registered office: 53 Hillery Road, Worcester, WR5 1RF, UK.

1.3 By using www.lynda-owen.co.uk you agree to be bound by these terms, which shall take effect immediately on your first use of www.lynda-owen.co.uk. If you do not agree to be bound by all of the following terms please do not access, use and/or contribute to www.lynda-owen.co.uk.

2.0 Use of www.lynda-owen.co.uk

2.1 You agree to use lynda-owen.co.uk only for lawful purposes, and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of lynda-owen.co.uk. Prohibited behaviour includes harassing or causing distress or inconvenience to any person, transmitting obscene or offensive content or disrupting the normal flow of dialogue within lynda-owen.co.uk.

3.0 Intellectual Property

3.1 All copyright, trade marks, design rights, patents and other intellectual property rights (registered and unregistered) in and on www.lynda-owen.co.uk and all content (including all applications) located on the site shall remain vested in Lynda Owen.

4.0 Contributions to www.lynda-owen.co.uk

4.1 By sharing any contribution (including any text, photographs, graphics, video or audio) with Lynda Owen you agree to grant to Lynda Owen, free of charge, permission to use the material in any way she feels fit (including modifying and adapting it for operational and editorial reasons) for Lynda Owen services in any media worldwide (including on Lynda Owen's site accessed by international users). In certain circumstance Lynda Owen may also share your contribution with trusted third parties*.

4.2 Copyright in your contribution will remain with you and this permission is not exclusive, so you can continue to use the material in any way including allowing others to use it.

4.3 In order that Lynda Owen can use your contribution, you confirm that your contribution is your own original work, is not defamatory and does not infringe any UK laws, that you have the right to give Lynda Owen permission to use it for the purposes specified above, and that you have the consent of anyone who is identifiable in your contribution or the consent of their parent / guardian if they are under 16.

4.4 We normally show your name with your contribution, unless you request otherwise, but for operational reasons this is not always possible. The Lynda Owen may need to contact you for administrative or verification purposes in relation to your contribution, or in relation to particular projects.

4.5 Please do not endanger yourself or others, take any unnecessary risks or break any laws when creating content you may share with the Lynda Owen.

4.6 If you do not want to grant Lynda Owen the permission set out above on these terms, please do not submit or share your contribution to or with lynda-owen.co.uk.

*In the case of news-related material please note that this may be shared with the Lynda Owen's affiliates; these are all reputable and prohibited from altering the material in any way or providing it to the print media.

5.0 lynda-owen.co.uk communities

5.1 In order to participate in and contribute to selected lynda-owen.co.uk communities you may be required to register with lynda-owen.co.uk. Any personal information supplied to lynda-owen.co.uk as part of this registration process and/or any other interaction with lynda-owen.co.uk will be collected, stored and used in accordance with this sites privacy policy.

5.2You agree to use lynda-owen.co.uk communities (including message boards) in accordance with the following Community Rules. You should, however, read the local house rules of the particular service you're using, as there may be some local variations to these Community Rules:

5.2.1 About your posts:

  • Contributions must be civil and tasteful.
  • No disruptive, offensive or abusive behaviour: contributions must be constructive and polite, not mean-spirited or contributed with the intention of causing trouble.
  • No unlawful or objectionable content: unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually oriented, racially offensive or otherwise objectionable material is not acceptable.
  • Be patient: users of all ages and abilities may be taking part in the relevant lynda-owen.co.uk community.
  • No spamming or off-topic material: we don't allow the submission of the same or very similar contributions many times. Please don't re-submit your contribution to more than one discussion, or contribute off-topic material in subject-specific areas.
  • No advertising or promoting other than that included by the site operators.
  • Contributions containing languages other than English may be removed unless allowed in the relevant local house rules.
  • No impersonation.
  • No inappropriate (e.g. vulgar, offensive etc) user names.
  • URLs (web site addresses) can only be posted if allowed under any relevant local house rules.
  • Deliberate misuse of the complaints facility is not permitted. If you persist in doing this, action may be taken against your account.

5.2.2 Your lynda-owen.co.uk Account:

5.2.2.1 If you use multiple logins for the purpose of disrupting a community or annoying other users you may have action taken against all of your accounts.

5.2.2.2 All accounts must be registered with a valid personal email address that you access regularly so that moderation emails can be sent to you. Accounts registered with someone else's email address, or with temporary email addresses may be closed without notice. We may require users to re-validate their account if we believe they have been using an invalid email address.

5.2.2.3 The Lynda Owen reserves the right to close accounts if any user is seen to be using proxy IPs (Internet Protocol addresses) in order to attempt to hide the use of multiple accounts, or if an non UK user pretends to be a UK user, or disrupts any of our services in any way.

5.2.3 Safety:

5.2.3.1 We advise that you never reveal any personal information about yourself or anyone else (for example: telephone number, postal address, home address or email address or any other details that would allow you to be personally identified) in any Lynda Owen community.

5.2.3.2 You are strongly advised the ensure that any computers you use are protected against infection of computer viruses, malicious programmes and hi-jacking attacks. This can be achieved by installing and running reputable security and firewall software.

5.2.4 Legal requirements:

  • You may not submit or share any defamatory or illegal material of any nature in lynda-owen.co.uk communities. This includes text, graphics, video, programs or audio.
  • Contributing material to a lynda-owen.co.uk community with the intention of committing or promoting an illegal act is strictly prohibited.
  • You agree to submit to or share with lynda-owen.co.uk communities only contributions which are your own original work. You must not violate, plagiarise, or infringe the rights of Lynda Owen or third parties including copyright, trade mark, trade secrets, privacy, publicity, personal or proprietary rights.

5.2.5 If you're under 16:

  • Please get a parent's or guardian's permission before taking part in any lynda-owen.co.uk community.
  • Never reveal any personal information about yourself or anyone else (for example, school, telephone number, your full name, home address or email address).

5.2.6 If you breach these Community Rules:

5.2.6.1 If you fail to abide by these Community Rules (and/or any variations in relevant local house rules) when taking part in a lynda-owen.co.uk community, you will be sent an email which informs you why your contribution has been refused or edited. This email will also include a warning that continuing to break the rules may result in action being taken against your account or accounts.

5.2.6.2 This action may include any content posted by you being checked before allowed to go on the site or a temporary or permanent suspension of your ability to participate in any or all of lynda-owen.co.uk community areas.

5.2.6.3 If you submit or share offensive or inappropriate content to or with any lynda-owen.co.uk communities or anywhere else on lynda-owen.co.uk or otherwise engage in any disruptive behaviour on lynda-owen.co.uk, and Lynda Owen considers such behaviour to be serious and/or repeated, Lynda Owen may use whatever information that is available about you to stop any further such infringements. This may include informing relevant third parties such as your employer, school, email provider or law enforcement agencies about the infringement(s).

5.2.6.4 The Lynda Owen reserves the right to moderate, alter or delete any contribution, or take action against any lynda-owen.co.uk account, at any time, for any reason.

6.0 Accuracy of content

6.1 Lynda Owen has taken every care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at time of publishing and all products have been fairly described. However, orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website.

6.2 All prices are displayed exclusive of VAT.

6.3 Packaging may vary from that shown.

6.4 The weights, dimensions and capacities given are approximate only.

6.5 We have made every effort to display as accurately as possible the colours of our products that appear on the website. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the product on delivery.

6.6 To the extent permitted by applicable law, Lynda Owen disclaims all warranties, express or implied, as to the accuracy of the information contained in any of the materials on this website.

6.7 Lynda Owen shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials on this website.

6.8 The views expressed in user generated content are the opinions of those users and are not necessarily those of Lynda Owen.

7.0 Damage to your computer

7.1 Lynda Owen makes every effort to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it won't cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website and screen out anything that may damage it.

7.2 Lynda Owen shall not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website or electronic transmissions from any electronic equipment owned or operated by Lynda Owen

8.0 Password/account security

8.1 You are responsible for maintaining the confidentiality of your password and account and any activities that occur under your account.

8.2 Lynda Owen shall not be liable to any person for any loss or damage which may arise as a result of any failure by you to protect your password or account.

9.0 Availability

9.1 All items are subject to availability. We will inform you as soon as possible if the goods you have ordered are not available by emailing you.

10.0 Ordering errors

10.1 You are able to correct errors on your order up to the point at which you click on ‘place order’ on the final page of our ordering process.

11.0 Delivery charges

11.1 Delivery charges vary depending on the type of products, weight, quantity ordered and the service you select and can not be refunded in accordance with your legal rights under the Distance Selling Regulations and other legislation.

12.0 Discount voucher codes

12.1 'lynda-owen.co.uk discount voucher codes' (also abbreviated to 'Voucher codes') can only be used against purchases made on lynda-owen.co.uk.

12.2 Voucher codes may only be redeemed on lynda-owen.co.uk - we are unable to accept voucher codes through Telesales orders or in person and may be redeemed against purchases for delivery to UK addresses only.

12.3 Selected voucher codes may be restricted for use against specified products only.

12.4 Voucher codes must be entered at the point of placing your order on lynda-owen.co.uk using the relevant part of the order form.

12.5 Voucher codes are restricted to one use per customer and should not be passed on to additional recipients.

12.6 We are unable to apply a discount to orders already placed.

12.7 Voucher codes cannot be used in conjunction with any other promotions. Only one voucher code may be used per order.

12.8 Where the voucher code entitles you to a percentage discount, the discount will not be applied to the delivery charge

12.9 Voucher codes may be withdrawn, or suspended without notice for any reason. We will advise you as soon as possible if we cannot accept the discount code you have entered.

12.10 Voucher codes may also be set to a maximum number of redemptions – if we are not able to accept the discount code you have entered for this reason we will advise you accordingly in the order process and the discount will not be applied.

12.11 Vouchers codes cannot be exchanged for a cash alternative.

12.12 We cannot be held responsible for non-availability of lynda-owen.co.uk which may prevent use of Voucher codes.

13.0 Acknowledgment and acceptance of your order

13.1 If you have supplied us with your correct email address, we will notify you by email as soon as possible to confirm receipt of your order. Our acceptance of your order will take place when our suppliers have confirmed the goods are available and we pass your details to our suppliers.

14.0 Delays

14.1 Occasionally, the supply of your order may be delayed. This can be for various reasons such as material shortages, import delays or higher than anticipated demand. We will, of course, make every effort to keep you informed.

15.0 Cancellation right

15.1 Under the distance selling regulations you have the legal right to cancel your order within seven working days of receipt of the goods (with the exception of flowers, plants, foods, perishable items, made to order products, jewellery designed for piercings, items that cause concern for hygiene and therefore cannot be resold, any electronically delivered products or services, ebooks, documents, templates, newspapers, magazines, periodicals and audio / video / software recordings where the original seal has been broken).

15.2 Lynda Owen and www.lynda-owen.co.uk cannot be held responsible for the return costs of cancelled items. This cost will be solely at the customers expense.

15.3 Unless we are notified otherwise we will presume that items have been successfully delivered 48hours (for UK orders) or 96hours (for international orders) after despatch. Our seven day cancellation period starts at this point. We will email the customer when the items are shipped and it is the customers responsibility to notify us if the couriers fail to deliver.

15.3 In the unlikely event that your items are arrive damaged or defective please contact us to arrange return of the damaged goods and despatch of replacements. Claims for damaged items must be made within 48 hours of receipt. Damaged goods must be returned and inspect by us before replacement items will be despatched.

16.0 Substitution

16.1 Sometimes, we may need to substitute one product, flower variety or plant, or indeed packaging and sundry items, for another. We reserve the right to substitute goods or packaging of equal quality and value. We will reimburse you for the cost of returning substitute goods that you do not wish to accept.

17.0 Restrictions on purchase

17.1 Where the order concerns:
a. Knives or bladed articles, by placing an order you confirm that you are over the age of 18.
b. Alcohol, by placing an order you confirm that you or the recipient of an alcohol gift are over the age of 18.
c. Classified videos and DVDs, by placing an order you confirm that you are over the age classified by the video/DVD.
d. Christmas crackers, by placing an order you confirm that you are over the age of 16.

18.0 Links to other websites

18.1 We have placed links on this website to other websites we think you may want to visit. We do not vet these websites and do not have any control over their contents. Lynda Owen cannot accept any liability in respect of the use of these websites.

19.0 Exclusions of liability

19.1 Some content posted in www.lynda-owen.co.uk is created by members of the public. The views expressed are theirs and unless specifically stated are not those of Lynda Owen. Neither Lynda Owen or the sites administrators are responsible for any content posted by members of the public on lynda-owen.co.uk or for the availability or content of any third party sites that are accessible through lynda-owen.co.uk.

19.2 Any links to third party websites from lynda-owen.co.uk do not amount to any endorsement of that site by Lynda Owen and any use of that site by you is at your own risk.

19.3 Any disclaimers and exclusions of liability in these terms & conditions shall not apply to any damages arising from death or personal injury caused by the negligence of Lynda Owen or any of her employees or agents or fraud. These disclaimers and exclusions shall be governed by and construed in accordance with English Law. If any provisions of these disclaimers and exclusions shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

19.4 Lynda Owen does not warrant that functions available on lynda-owen.co.uk will be uninterrupted or error free, that defects will be corrected, or that lynda-owen.co.uk or the server that makes it available are free of viruses or bugs. You acknowledge that it is your responsibility to implement sufficient procedures and virus checks (including anti-virus and other security checks) to satisfy your particular requirements for the accuracy of data input and output.

20.0 Other legal notices

20.1 There may be legal notices, warnings or disclaimers on other areas of this website which relate to your use of this website or the supply of goods all of which will, together with these terms & conditions govern your use of this website.

21.0 Changes to legal notices

21.1 We reserve the right to change these terms & conditions from time to time and you should look through them as often as possible and each time you purchase goods or services from Lynda Owen or www.lynda-owen.co.uk.

22.0 Use of this website from outside the UK

22.1 Unless otherwise specified, the materials on this website are displayed solely for the purposes of promoting Lynda Owen's products and services available in the United Kingdom and Lynda Owen makes no representation that any products or services referred to in the materials on this website are appropriate for use in or available for delivery to other locations outside of the UK. Those who choose to access this site from other locations are responsible for compliance with local laws if and to the extent local laws are applicable.

23.0 Law, jurisdiction and language

23.1 This website, any content contained herein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English Law. The parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.

24.0 Cancellations, amendments & returns

24.1 You can change your order up to the point of despatch. As soon as you realise that you need to change your order please contact us on 07976 522 204 and one of our advisors will help you.

24.2 If you amend your order, you may find there are changes to your delivery timescale and/or the price you pay for the item (as you’ll be charged the current selling price on the day you amend the order).

24.3 Once you have taken delivery of your order, you have a legal right to cancel your order within 7 days and return the goods to us for a refund (With the exception of items listed in Section 15.1 of this document). The packaging may be opened (except item in Section 15.1) but the goods should not be used. Items should be in the original packaging in a resaleable condition and returned or collection arrangements made promptly at your cost. If collection of an item is required, we will charge you the cost of collection (up to £100) of which you will be notified at time of cancellation.

25.0 Payment

25.1 All methods of payment, including credit cards are processed once your order has been been submitted to our website.

25.2 All payment processing is provided by Paypal.

26.0 Delivery Company

26.1 All orders are delivered by a third party courier. This will normally be Royal Mail or Airmail, however we reserve the right to change couriers at any time.

27.1 Delivery Arrangements

27.1 Normally your goods will be delivered within 2-3 day (uk) or 4-5 days (international) unless you specify another delivery option.

27.2 If access to your delivery address is restricted, please let us know when ordering your goods but we will not be held responsible for delay or failure of delivery.

27.3 If you are unable to accept delivery and the courier needs to re-schedule the delivery you may be charged for an additional incurred costs. If you need to change your delivery for any reason please call us on 07976 522 204.

27.4 If it is available to us, we will provide you with your consignment's tracking details to enable you to track the location of your delivery.

28.0 On Delivery

28.1 A signature is required on receipt of your goods. Upon signature the goods become the responsibility of the client.

29.0 Delivery Delays

29.1 Occasionally, delivery of your order may be delayed or postponed. We will, or course, make every effort to keep you informed and discuss revised delivery time scales.

30.0 After Delivery

30.1 Your product is supported by our guarantee and after sales service.

31.0 Payment Processing

31.1 Lynda Owen and www.lynda-owen.co.uk use https://www.Paypal.com to process your credit card transaction. The card details you provide to Paypal as not seen, stored, archived or printed by Lynda Owen or www.lynda-owen.co.uk. Lynda Owen does not accept any liability for personal or financial information lost, stolen, or mis-used by Paypal, its employers or third party contracted companies.

31.2 Lynda Owen and www.lynda-owen.co.uk are not responsible for the authorisation / clearing of credit card transactions. Should your transaction be declined we will be unable to despatch your items and will cancel the order you submitted.
